StartWell Terms of Use

Disclaimer: In the event of any discrepancy or conflict, the English version will prevail over any translation.
1. Overview
These Terms of Use (“Terms”) apply to the StartWell website and mobile app (collectively, the “Platform”) operated by Startwell Health And Wellbeing Private Limited (“Startwell,” “we,” “us,” or “our”), registered at FL 1104/1105/1106, PL 11-12, Sector-6, Symphony, Kharghar, Mumbai, Raigarh, Maharashtra 410210, India. Using the Platform constitutes your acceptance of these Terms. Each time you use the Platform, you reaffirm your acceptance, including any updates. If there are Service-specific terms in conflict with these Terms, the Service terms will prevail. These Terms are an electronic record and don’t require a physical or digital signature.
2. What We Do
a) Startwell enables ordering of Indian or continental meals for school children (kindergarten to 12th grade). You can pay online and track consumption.
b) We deliver meals to selected schools only; you may request your child's school to onboard.
c) Meals are prepared in our kitchen and delivered about 30 minutes before recess, then distributed in classrooms. Lunch boxes and jute bags are collected at the end of school hours.
d) Our menu includes vegetarian, healthy breakfast and lunch options, subject to change without notice.
e) Meals are packaged in stainless steel boxes, labeled with your child’s name, class, and section.
f) You may order daily, weekly, monthly, or per semester. Weekly menus are emailed to you. You can pause, modify, book, or cancel orders up to midnight before a delivery. Cancellations are credited to your Startwell wallet.
g) Meals are prepared by trained chefs, following FSSAI nutritional guidelines, using fresh, sustainable ingredients.
h) We maintain high hygiene standards through trained staff, regular cleaning, HACCP protocols, temperature control, pest management, and compliance with hygiene standards.
i) You, school staff, or students may visit our kitchens during operational hours.
j) If we fail to deliver on time (not due to force majeure), you will not be charged, or will be credited via wallet.
3. Ordering
a) You warrant that personal and payment details provided are correct and belong to you.
b) We are responsible for any food quality issues (e.g., labeling).
c) You must ensure ordered food suits your child’s age.
4. Prices and Payment
a) Prices listed are accurate at posting time. We may change menu offerings or prices anytime.
b) Changes in price don’t create liability for us.
c) Total price—including taxes and fees—is shown when ordering, and invoices emailed.
d) Online payments are secured and encrypted. Payment providers may perform security checks.
5. Delivery
a) If delivery fails due to unavailability, your order will be canceled, and you notified via email. We are not liable for damages in such cases.
b) Late deliveries are not refunded or voided.
c) If the school fails to accept delivery, the order is considered delivered, and you are responsible for storage and associated costs.
d) We are not liable for damage due to inadequate delivery access or arrangements.
e) Delivery times are approximate; time is not of the essence.
6. Eligibility
Platform services are available only in select Indian geographies. Residents declared legally incompetent (e.g., insolvents) cannot use the Platform.
Corporates or minors (13–18 years) may use the Platform only through authorized or parental/legal guardian supervised accounts.
7. Your Account
You are responsible for account confidentiality and all actions taken under your account. Notify us immediately if you suspect account compromise. Only one account per user is permitted. Accounts are for personal use only and cannot be transferred.
8. Privacy
Your personal data is processed according to our Privacy Notice. If you object, please do not use the Platform.
9. Platform Access
We aim for uninterrupted access but cannot guarantee it. Maintenance or updates may result in temporary access limitations.
10. License for Platform Access
We grant you a limited, personal, non-commercial, revocable license to use the Platform. Unauthorized copying, framing, data mining, or commercial exploitation is prohibited.
11. Your Conduct
You must use the Platform lawfully. You may not upload content that is illegal, infringing, pornographic, offensive, harmful, misleading, or anything that causes system disruption. We may remove or restrict access for violation.
Users retain copyright to their posts but grant Startwell a global, royalty-free, sublicensable license to use that content indefinitely. You must warrant your submitted content is accurate and lawful; you indemnify us for any breach.
12. Product Details
Product pages show pricing, taxes, origin, expiry dates, and warranties. Descriptions and images are indicative and may not be error-free. We may correct errors or omissions anytime, even after ordering. Recommendations are informational only.
13. Conditions of Sale
Placing an order is an offer; acceptance occurs when dispatched. You may cancel before dispatch with no charges.
14. Limitation of Liability
Products are provided “as is.” We disclaim warranties and are not liable for post-delivery handling, allergies, or consumption beyond four hours. You are responsible for dietary decisions. Any liability is limited to the amount paid. We are not liable for indirect or consequential damages.
15. Indemnity and Release
You indemnify Startwell and affiliates against claims arising from your use of the Platform, content, or breach of these Terms.
16. Communications
You consent to receive communications via email, SMS, calls, or notices posted on the Platform, including promotional and transactional messages.
17. Losses
We are not liable for business losses, indirect, or non-foreseeable damages.
18. Changes to Terms
We may modify these Terms anytime; your continued usage implies acceptance.
19. Force Majeure
We are not liable for obligations frustrated by events beyond our control, such as natural disasters or civil unrest.
20. Waiver
Our failure to enforce a Term doesn’t waive our rights.
21. Copyright and Trademark
All Platform content is owned or licensed by Startwell. Personal, non-commercial use is allowed; other use is prohibited without permission.
22. Governing Law & Dispute Resolution
These Terms are governed by Indian laws (Maharashtra). Disputes will first be addressed through negotiations and, if unresolved in 30 days, may go to arbitration in Mumbai. Courts in Mumbai have exclusive jurisdiction.
23. Assignment
You may not transfer your rights or duties under these Terms without consent.
24. Severability
If any provision is deemed invalid, the rest remain enforceable.
25. Software Terms
Any software we provide is for personal use only and not for distribution or modification. We may revoke access or updates at any time.
26. Termination
You or we may terminate these Terms anytime. You must destroy downloaded materials. We may terminate without liability. Account deletion data is retained for 180 days.
27. Disclaimers
We disclaim all warranties related to product/service quality, accuracy, or uptime. We’re not liable for viruses or unauthorized access. You assume risks in using the Platform and third-party links.
28. Grievances
We adhere to fair grievance handling. Contact customer support via phone or email; complaints are tracked with a ticket number. Escalate to the grievance officer if unresolved.
29. Ticketing System
Email complaints result in a ticket number for tracking.
30. Customer Chat
Customer support is available via chat (9 am–5 pm) with ticket-based tracking.
31. Unsatisfied Complaints
Escalate unresolved issues to the grievance officer (Founder & CEO) by including your ticket number.
32. Infringement Claims
For copyright concerns, email the grievance officer with a “Takedown Request,” affidavit, infringement details, and your contact information.
33. Indemnities
You indemnify Startwell for any loss or liability from your negligence, Platform use, or content submission.
