We understand that you care how information about you is used and shared, and we appreciate your trust that we will do so carefully and sensibly. This Privacy Notice describes how Startwell Health And Wellbeing Private Limited (“Startwell” or “us” or “we” or “our”) and its affiliates (including our delivery partners) collect and process your personal information through the Startwell Platform, devices, products, services, online marketplace and applications that reference this Privacy Notice (together "Services").
By using the Platform (as defined in our Terms of Use) and/or by providing your information, you agree and consent to us collecting, storing, processing, transferring, using and sharing of your personal information (including sensitive personal information as per applicable law) that you disclose on the Platform with third parties or service providers for the purposes set out and in accordance with this Notice.
By using Services you agree to our use of your personal information (including sensitive personal information) in accordance with this Privacy Notice, as may be amended from time to time by us at our sole discretion. You also agree and consent to us collecting, storing, processing, transferring, and sharing your personal information (including sensitive personal information) with third parties or service providers for the purposes set out in this Privacy Notice.
Personal information subject to this Privacy Notice will be collected and retained by Startwell, with our Registered Office situated at FL 1104/1105/1106, PL 11-12, sector-6, symphony, Kharghar, Mumbai, Raigarh, Maharashtra, India, 410210. We play the role of a Data Controller when we collect and process personal information about you. We play the role of a Data Processor when we collect and process personal information on behalf of another Data Controller.
While you may be able to browse the Platform from countries outside of India, however please note we do not offer any product/service under this Platform outside India. By visiting the Platform or providing your information, you expressly agree to be bound by this Notice and agree to be governed by the laws of India including but not limited to the laws applicable to data protection and privacy. If you do not agree please do not use or access our Platform. In this Notice, the expressions ‘personal information’, ‘data subject’, ‘controller’, ‘processor’ and ‘processing’ shall have the meanings given to them in the applicable privacy laws. Terms not otherwise defined herein will have the meanings attributed to them in our Terms of Use, which is to be read along with this Notice.


What Personal Information does Startwell Collect from You?
We collect your personal information in order to provide and continually improve our products and services. Here are the types of personal information we collect:

  1. Information You Give Us

    • a. Your child's details: Name, age, and school details are necessary for us to deliver the product(s) based on your order(s). We do not collect more data than necessary pertaining to your child. We do not profile, track, behaviorally monitor, or host targeted advertisements directed towards your child, or engage in any processing of data which may cause significant harm to your child.

    • b. Location, file access and storage permissions: With your prior permission to provide and improve some important features of the Services, we may need information regarding your location and other information from your device's camera and photo library—we will ask for explicit device permissions which you can revoke anytime.

    • c. Usage Data: This Data is collected automatically for the purpose of improving the Services. Usage Data includes your Device’s Internet Protocol (IP) address, OS details, browser type and version, pages visited, time and date of visit, duration on pages, unique device identifiers, and diagnostic data.

    • d. Public content: Content, details, or media you share on public-viewable screens may enter the public domain and be saved by others. Users are responsible for sharing media in free-text areas; we disclaim any responsibility.

  2. Automatic Information
    We automatically collect and store information about your use of Services, including interaction with content. This includes tracking via cookies and other unique identifiers, as well as information from your browser or device during Service access.

  3. Information from Other Sources
    We may receive updated delivery and address information from delivery partners to correct our records and facilitate future deliveries.


Examples of Information Startwell Collects from You
You provide information when you:

  • Search or shop on our platform

  • Add/remove items from cart or place orders

  • Download, stream, view, or use content

  • Provide your or your child's profile information

  • Upload contacts for certain services

  • Configure settings or give permissions

  • Communicate via phone, email, support tickets, etc.

  • Upload media during use of services

  • Participate in forums, reviews, and alerts

This data may include name, address, phone, payment info, age, location, IP, contacts, messages, photos, identity documents (e.g., PAN), credit history, corporate/financial info.

Automatic Information includes IP addresses, login credentials, device details, content interaction metrics, errors, settings, clickstream data, customer service call numbers, and media files in the marketplace.

Other Sources: We also collect from carriers, co-branded merchants, affiliates, and paid search listings.


Information You Can Access
Through the "Your Account" section you can access:

  • Recent orders, order history

  • Personal identifiers (name, email, password, address)

  • Payment settings, notification preferences

  • Recommendations, viewed products

  • Shopping lists, registries

  • Devices, services, communication preferences

  • Voice recordings and profile details including reviews and reminders

  1. Purchase & delivery, payments, communication

  2. Providing, troubleshooting, improving Services

  3. Recommendations & personalization (anonymized)

  4. Voice, image, camera services

  5. Legal compliance (e.g., onboarding sellers)

  6. Communication across channels

  7. Fraud prevention & credit risk assessment

  8. Data processing with affiliates/third parties

  9. Aggregating data for trends & insights

Do-Not-Track signals: We currently do not respond to them.


Cookies
We use cookies (strictly necessary, functional, performance) to:

  • Recognize users, personalize experiences

  • Track preferences, support shopping cart, diagnostics

  • Security, Preventing fraud, Reporting services performance

Blocking cookies may impair functionality like sign-in, cart, checkout. Approved third parties may also set cookies for ads, analytics, and social media. Manage through browser settings.


Sharing Your Personal Information
We do not sell customer data. Sharing occurs only with:

  1. Third-party service providers (e.g., payment gateways, fulfillment, marketing)

  2. Third parties working under contract with limited use rights

  3. Business transfers (e.g., mergers, acquisitions)

  4. Enforcement, fraud detection, legal compliance

Storage: Primarily within India; third-party providers may store/process elsewhere under safeguards.


Cross-Border Data Transfer
Your data may be transferred outside India per applicable law. Those jurisdictions may have different confidentiality standards, and disclosure may occur under legal processes. We aim to maintain accuracy and protection under these transfers.


Data Security
We implement physical, technical, and managerial safeguards, use encryption, adhere to PCI DSS for payment data, and secure with multi-layer controls. Third-party vendors have contractual security obligations. Access disclosure may require identity verification.


Data Retention
We retain personal data as needed for service provision, legal compliance, disputes, or legitimate interests. Consent records are kept for five years. Accounts inactive for six months may be disabled or deleted. Deleted accounts are removed from public pages.


Your Rights & Access
You may access and correct your data (name, address, payment, purchase history). Rights include:

  • Confirmation and access

  • Correction

  • Deletion (“Right to be Forgotten”)

  • Restriction or objection

  • Data portability

  • Withdrawal of consent

  • Filing regulatory complaints

Terms, Revisions & Notices
Your use is governed by this Privacy Notice and our Terms of Use, which include provisions like dispute resolution and applicable law. We will not materially weaken past practices without consent. Changes will be posted promptly and effective immediately; your continued use implies acceptance.

Infringement
For copyright claims, email prithvi@startwell.in with “Takedown Request” and:

  • An affidavit of authority

  • Detailed identifier of infringing material

  • Statement of good-faith belief

  • Contact information


Indemnities
You indemnify Startwell for all claims, losses, liabilities, or legal costs arising from your misuse, misconduct, uploading content, or breach—except where prohibited by law.


Need to Know

  • Startwell will never request OTP/CVV/PIN/Card number/Bank details except during payment processing.

  • They never call with offers, gifts, or discounts.

  • Beware of phishing attempts; Startwell will not solicit by such means.

  • Sharing sensitive information with fraudsters is not the company’s responsibility. Report suspicious attempts to grievance officer or customer care.

  • Emails to prithvi@startwell.in may be redirected to hello@startwell.in if grievance protocol isn’t followed.

  • Payment/refund issues may involve partner banks and could cause delays beyond Startwell’s control, though they aim to meet timelines.


Severability
If any provision is invalid or unenforceable, it will be deemed removed without affecting the rest of the Notice.
